Government Immunity from Tort Liability & Labour Arbitrator’s Jurisdiction

This week we have another two decisions to predict. On Thursday, October 21, 2021, the Supreme Court of Canada is releasing its decision in City of Nelson v. Taryn Joy Marchi. At issue is whether a government decision is considered a policy decision or an operational decision. Policy decisions are immune from tort liability, so this could be significant for COVID-19 related litigation. On Friday, October 22, 2021, the SCC is releasing Northern Regional Health Authority v. Linda Horrocks and Manitoba Human Rights Commission. At issue is the exclusive jurisdiction of a labour arbitrator and the standard of review between levels of court.
